Privacy Policy

The Institute of Advanced Motorists New Zealand (IAMNZ), also known as IAM RoadSmart NZ complies with the New Zealand Privacy Act 2020 (the Act) when dealing with personal information. Personal information is information about an identifiable individual (a natural person) or group of information that enables identification.

This policy sets out how we collect, use, disclose and protect your personal information.

This policy does not limit or exclude your rights under the Act.

We may change this policy by uploading a revised policy onto the website.  The change will apply from the date that we upload the revised policy.

When you sign up with us or express an interest in joining, you give us your consent to collect your information. Without this consent, we cannot store or process your information, and you will not be able to be a member. We do not aim to hold or process data that is not useful to our purposes and will not process data about:

  • Race or ethnic origin
  • Political opinions
  • Religious or philosophical beliefs
  • Trade union memberships
  • Genetic or biometric data
  • Sex life or sexual orientation

We will collect basic information such as gender and age for statistical purposes and analysis, if provided, to understand our membership and improve our services.

IAM NZ is the data controller of your information and we collect personal information about you from:

  • You, when you provide that personal information to us, including via the website and any related service, through any registration or subscription process, through any contact with us (e.g. telephone call or email), or when you buy or use our services and products
  • Third parties where you have authorised this or the information is publicly available.
  • We also generate information about you, from the services we offer you.

We will use your personal information to:

  • verify your identity
  • record your membership status and any tests you have completed
  • record your progress with IAMNZ
  • provide our services, products and business activities (including voting) to you, including contacting you electronically (e.g. by text or email for this purpose)
  • bill you and collect money that you owe us for subscriptions, including authorising and processing credit card transactions when applicable
  • respond to communications from you, including a complaint
  • conduct research and statistical analysis (on an anonymised basis)
  • protect and/or enforce our legal rights and interests, including defending any claim
  • for any other purpose authorised by you or the Act.

We may disclose your personal information to:

  • our members in roles to conduct any activity relating to your membership
  • businesses that support our services and products, including any person who hosts or maintains any underlying IT system or data centre that we use to provide the website or other services and products.
  • businesses that provide sponsorship or discounts and need to confirm your membership status
  • a person who can require us to supply your personal information (e.g. a regulatory authority)
  • any other person authorised by the Act or another law (e.g. a law enforcement agency)
  • any other person authorised by you
  • Your information is not sold to any other organisation

We will take reasonable steps to keep your personal information safe from loss, unauthorised activity, or other misuse. We will inform you in a timely manner if our systems are breached, in accordance with law, along with informing the relevant authorities.

If you leave IAMNZ we will continue to hold your data to meet any applicable laws or your possible resumption of membership. If you are an EU resident you have the right to be forgotten, subject to law, but note that in the event of any return, there can be no resumption of any previous status that may have been held, if you choose to exercise this right.

You can control which information you receive from us, such as marketing material. Although, some communication is required to maintain your membership to our organisation that cannot be opted out of.

While we take reasonable steps to maintain secure internet connections, if you provide us with personal information over the internet, the provision of that information is at your own risk.

If you post your personal information on the website’s chat facility or message board (if available) or social media platforms you acknowledge and agree that the information you post is publicly available.

If you follow a link on our website to another site, the owner of that site will have its own privacy policy relating to your personal information.  We suggest you review that site’s privacy policy before you provide personal information.

We use cookies (an alphanumeric identifier that we transfer to your computer’s hard drive so that we can recognise your browser) to monitor your use of the website.  You may disable cookies by changing the settings on your browser, although this may mean that you cannot use all of the features of our website.

Under the Privacy Act 2020, you have the right subject to certain grounds for refusal, to access or ask us to correct any personal information you provided to us.

We may require proof of your identity before being able to provide you with any personal information.
